YYC Cornhole Tournaments – Release Waiver – 2018
The activity waiver & release dated June 8, 2019 between YYC Cornhole and any tournament participant.
In consideration of the covenants and agreements contained in this agreement and other good an valuable considerations, the receipt of which is hereby acknowledged, the parties to this agreement agree as follows:
1.0 Being of lawful age and in consideration of being permitted to participate in the activity being described, the participant releases and forever discharges YYC Cornhole and all of its members, legal representatives and assigns from all manner of actions, causes of action, debts, accounts, contracts, claims and demands for or by reason of any injury to person or property, including injury resulting in the death of the participant, which has been or may be sustained as a consequence of the participants participation in the activity being described, and not withstanding that such damage, loss or injury may have been caused solely or partly by the negligence of the Activity Provider.
2.0 The Releasor understands that the Releasor would not be permitted to participate in the activity being described unless the Releasor signed the Agreement.
3.0 Details of Activity. The participant will be partaking in several Cornhole matches which involve being outdoors, throwing of bean in order to win a game. The activity involves 2 cornhole boards, 8 bean bags and 4 participants / game. Event time will last between 3-4 hours in length.
4.0 Concurrent Release. The participant acknowledges that this agreement is given with the expressed intention of effecting the extinguishment of certain obligations owned to the participant and with the intention of binding the participant's spouse, heirs, executors, administrators, legal representatives and assigns.
5.0 Fitness to Participate. The participant acknowledges that the participant does not have any physical limitations, medical ailments, physical or mental disabilities that would limit or prevent the participant from participating in the activity/tournament. If required, the participant will obtain a medical examination and clearance.
6.0 Full and Final Settlement. The participant hereby acknowledges and agrees that the participant has carefully read this agreement, that the participant fully understands the same, and that the participant is freely and voluntarily executing the same. This includes both team members
7.0 The participant understands that by checking the box left of this statement during ticket purchasing, the participant agrees to be forever prevented from suing or otherwise claiming against YYC Cornhole for any property loss or personal injury that the participant may sustain while participating in or preparing for the listed activity.
8.0 The participant has been given the opportunity and has been encouraged to seek independent legal advice prior to signing this agreement.
9.0 This agreement contains the entire agreement between the parties to this agreement and the terms of this agreement are contractual and not a mere recital.
10.0 Governing Law. This agreement will be construed in accordance with and governed by the laws of the Province of Alberta.
Once tickets are purchased. No refunds will be given. A credit for a future tournament date will be applied. Both parties agree that everything listed above have been sealed.
